- Arbitrate disputes, advise counsel, jury, litigants, or court personnel, and administer judicial system. Establish rules of procedure on questions for which standard procedures have not been established by law or by superior court. Read or listen to allegations made by plaintiff in civil suits to determine if evidence will support charges, listen to presentation of case, rule on admissibility of evidence and settle disputes between opposing attorneys. Instruct jury on applicable law. Instruct jury to reach a verdict from evidence presented at trial. Sentence defendant in criminal cases, on conviction by jury, according to state or Federal statutes, or award judicial relief to litigants in civil cases. May be designated according to level of court in judicial hierarchy (Appellate, District, Municipal, Superior, Supreme, etc.).
Magistrates—-Adjudicate civil cases in which damages do not exceed prescribed maximum established by state law, and minor misdemeanor cases not involving penitentiary sentences or fines in excess of maximum amount to be levied under state laws. Conduct preliminary hearings in felony cases to determine whether there is reasonable and probable cause to hold defendant for further proceedings or trial by superior court. May adjudicate cases involving motor vehicle laws and be designated a Traffic-court Magistrate.
Exclude the following occupations: Appeals reviewers (conduct hearings and determine validity of claims for veteran's benefits); mediators or conciliators (mediate and conciliate disputes over negotiations of labor agreement or other labor disputes); arbitrators (arbitrate disputes between management and labor to bind both to specific terms and conditions of labor contract). These jobs are included in B027.
